MSM Unify (“Portal”) is operated by MSM Global Education Private Limited (“MSM Unify”, “we”, “us” or “our”). By accessing, registering on, submitting an enquiry/application through, or otherwise using the Portal, you acknowledge and agree to these Terms & Conditions (“Terms”) and the Privacy Policy set out below. You confirm that the information you provide, including your name, email address, mobile number, educational details and other information, is true, accurate and complete.

The Portal provides information, counselling, admission assistance and other education-related services in relation to programmes and institutions. Submission of an enquiry or application does not guarantee admission, scholarship, employment, visa approval or any particular outcome. Final admission and academic decisions remain solely with the relevant educational institution.

You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to independently accept these Terms and use the Portal. If you are under 18 years of age, you may use the Portal only with the involvement and verifiable consent of a parent or legal guardian, obtained through the process described in Section 9 (Minors’ Data) of the Privacy Policy below. Where a parent or guardian submits an enquiry or application on behalf of a minor, that parent or guardian is responsible for the accuracy of the information provided and for supervising the minor’s continued use of the Portal.

The Portal may provide information, counselling, admission assistance and other education-related services in connection with programmes and institutions. MSM Unify does not act as, and shall not be represented as, an employee, admissions officer or agent of any educational institution unless expressly authorised in writing by that institution. Any counselling or guidance provided is for informational assistance only and does not constitute a guarantee of admission, financial aid, visa approval or employment outcome.

You agree not to:

• misuse the Portal or attempt to interfere with its security, integrity or normal operation;
• provide false, misleading or fraudulent information, or submit forged or altered documents;
• impersonate any person or misrepresent your affiliation with any person or entity;
• infringe the intellectual property, privacy or other rights of MSM Unify or any third party;
• use the Portal for any unlawful purpose or in violation of applicable law.

MSM Unify India reserves the right to suspend or terminate your access to the Portal, and to reject or discontinue processing any enquiry or application, if you breach this Section.

Certain services, applications, counselling, subscriptions or other offerings available through MSM Unify India Campus (“Platform”) may be subject to applicable fees (“Fees”). The applicable Fees, taxes, payment terms and any specific cancellation or refund conditions will be communicated to you at the time of purchase or application.

5.1 Payments

Payments may be made through the payment methods made available on the Platform. A payment will be considered successful only upon confirmation by the Company or its authorised payment service provider. You are responsible for providing accurate payment information and retaining relevant payment confirmations.

5.2 Platform and Institutional Fees

Fees payable to MGEP for services provided through the Platform are separate from tuition fees, admission fees, deposits or other charges payable to a third-party educational institution.

Where a payment relates to a third-party institution, the applicable fees, cancellation and refund policies of that institution shall apply. MGEP shall not be responsible for refunds that are to be processed by the relevant institution.

5.3 Cancellation

Cancellation requests shall be subject to the terms communicated at the time of purchase or application. Unless otherwise specified, Fees for services that have commenced, been substantially performed or made available to you may be non-refundable, subject to applicable law.

Non-use of a service, failure to attend a scheduled service, change of mind or failure to provide required information or documents will not, by itself, create an entitlement to a refund.

5.4 Refunds

Where a refund is applicable, it shall be processed in accordance with the applicable refund terms and applicable law. Approved refunds will ordinarily be made through the original payment method, and processing time may depend on the relevant bank, payment gateway or payment service provider.

Application, registration, administrative, processing or other charges specifically identified as non-refundable at the time of payment shall not be refundable, except where otherwise required by applicable law.

5.5 No guarantee-linked refunds

For the avoidance of doubt, fees paid for counselling, application-assistance or similar services are charged for the service rendered and are not contingent on the outcome of any application, admission, scholarship or visa decision, except where MSM Unify India expressly agrees otherwise in writing.

5.6 Admission Outcomes

Payment of any Fee does not guarantee admission, selection, scholarship, visa approval or any other educational outcome. Admission decisions, eligibility, seat availability and institutional fees are determined by the relevant educational institution.

5.7 Statutory Rights

Nothing in this section shall limit or exclude any statutory or consumer rights or remedies that cannot lawfully be excluded under applicable law.

Where you voluntarily submit your contact details through the Portal, MSM Unify India and/or its authorised representatives, service providers or educational partners may contact you by telephone, SMS, email, WhatsApp or other permitted channels regarding your enquiry, application, counselling and the services you have requested (“Service Communications”). Service Communications are necessary to deliver the services you request and are not conditional on separate marketing consent.

Separately, and only where you have given an additional, specific and affirmative opt-in as described in Section 4 of the Privacy Policy, MSM Unify India may send you promotional or commercial communications about programmes, offers or related opportunities (“Promotional Communications”). You may withdraw consent to Promotional Communications at any time using the unsubscribe/opt-out mechanism provided, or by contacting us at info@msmunify.com. Withdrawal will not affect Service Communications necessary to deliver a service you have already requested, nor the lawfulness of processing carried out before withdrawal.

All content on the Portal, including text, graphics, branding, trademarks and software, is owned by or licensed to MSM Unify India and may not be reproduced, distributed or commercially exploited without MSM Unify India’s prior written permission.

8.1 The Portal and any counselling, information or guidance provided through it are made available on an “as is” and “as available” basis. MSM Unify India does not warrant that the Portal will be uninterrupted, error-free or that any information provided (including about institutions, programmes, fees or eligibility criteria) is complete, current or accurate at all times, as such information is often supplied by, or subject to change by, third-party institutions.

8.2 To the maximum extent permitted by applicable law, MSM Unify India shall not be liable for any indirect, incidental, consequential or special loss or damage arising out of or in connection with your use of the Portal, including loss arising from a third-party institution’s decision, delay or conduct.

8.3 Nothing in this Section excludes or limits MSM Unify India’s liability where such exclusion or limitation is not permitted under applicable Indian law, including the Consumer Protection Act, 2019, or for fraud, wilful misconduct, or death or personal injury caused by MSM Unify India’s negligence.

MSM Unify India may modify, suspend or discontinue any part of the Portal or its services, and may update these Terms from time to time. Material changes will be indicated by an updated “Last Updated” date on the Portal. Continued use of the Portal after such changes take effect constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Subject to any mandatory statutory consumer rights and remedies available to you (including the right to approach the consumer forum under the Consumer Protection Act, 2019, or the Data Protection Board of India under the DPDP Act, 2023, as applicable), any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Ahmedabad, Gujarat, India.
